At a glance

These are the rules for using BlinkPop. The short version, which is not a substitute for the rest:

  • You must be 18 or over. BlinkPop puts strangers in the same room. That is not a product for minors.
  • There is zero tolerance for abusive users and objectionable content. Report it and we will review it within 24 hours and remove content and users that break these rules.
  • You own what you post. You give us only the permission we need to show it inside BlinkPop.
  • Meeting people in real life carries real risk. We do not verify identities or run background checks. Use your judgement, meet in public, and tell someone where you are going.
  • BlinkPop is free, new, and provided as is. One person builds it. It may break, and our liability is limited.

1. Agreement

BlinkPop is operated by Tan Jin Xue, an individual based in Malaysia (“BlinkPop”, “we”, “us”). These Terms of Service (“Terms”) govern your use of the BlinkPop mobile app and the blinkpop.app website (together, the “Service”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. You must be 18

You must be at least 18 years old to use BlinkPop. By using it you confirm that you are. If we learn that an account belongs to someone under 18, we will terminate it and delete its data.

3. Your account

You sign in through Google or Apple. Keep that account secure — you are responsible for what happens under your BlinkPop account. Give us accurate information, do not impersonate anyone, and do not create an account if we have previously banned you.

You can delete your account at any time from Settings → Delete account. What that removes, and the two things it deliberately does not, is set out in the Privacy Policy.

4. Content you post

4.1 You keep ownership

Everything you post — Pops, photos, posts, messages, your profile — stays yours. We claim no ownership of it.

4.2 The permission you give us

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and distribute your content solely in order to operate and provide the Service — for example, showing your Pop to people nearby, rendering a share link preview, or delivering your message to its recipient. This licence exists only so BlinkPop can function. It does not let us sell your content, put it in advertising, or license it to anyone else, and it ends when you delete the content or your account, except for copies we must keep for the moderation and safety reasons described in the Privacy Policy.

4.3 You are responsible for it

You confirm you have the right to post what you post, and that it does not infringe anyone else’s rights.

6. Reporting, blocking, and what we do about it

Profiles, Pops and posts can be reported from the ··· menu in the app, and you can block any user from their profile or from a direct message. Blocking is immediate and stops that person from seeing you or contacting you. Individual messages cannot yet be reported in-app — report the sender’s profile and email us, and see our Support page for the exact steps.

We review every report within 24 hours and remove content that breaks these rules, along with the accounts of the users who posted it. Depending on severity we may remove a single Pop or message, restrict an account, or ban it permanently. Serious cases are reported to the relevant authorities. You can also report a user or content by emailing hello@blinkpop.app — see our Support page.

We may remove content or suspend an account without notice where we judge it necessary to protect people. If you think we got it wrong, email us and we will look at it again.

7. Meeting people in real life

This is the section that matters most, so we will not bury it in capitals.

BlinkPop helps you find gatherings and people near you. It does not verify anyone’s identity, run background checks, or vet who turns up. You are solely responsible for your own safety when you meet people you found through BlinkPop. Meet in public places. Tell a friend where you are going. Trust your instincts and leave if something feels wrong. Do not share your home address with someone you have just met.

Interactions between users are between those users. We are not a party to them, we do not supervise them, and to the fullest extent the law allows we are not responsible for what happens at a Pop or between users — including any injury, loss, or harm. If someone behaves badly, report them; if someone is in danger, contact your local emergency services first.

8. Pops, places, and money

If you create a Pop, you are its host and you are responsible for it — that it is accurate, that you have any permission you need from the venue, and that it complies with the law.

BlinkPop does not process payments. A price shown on a Pop is informational only, so you know roughly what it will cost you to turn up. Any actual payment happens directly between you and the host or the venue, and we are not involved in it, not responsible for it, and cannot refund it.

Places listed in BlinkPop come from public data and from users. Nothing in the Service is an endorsement of, or affiliation with, any venue.

9. Our content and our name

The Service itself — its software, design, and the BlinkPop name and logo — belongs to us. We grant you a personal, limited, non-transferable, revocable licence to use the app for its intended purpose. You may not copy the Service, build a competing product from it, or use our name or logo without our written permission.

If you send us feedback or suggestions, we may use them freely and without owing you anything. Please do not send us anything you consider confidential.

10. Changes and availability

BlinkPop is early software. We may change, suspend, or discontinue any part of it, and we are not obliged to provide support or to keep any feature working. We will try to give notice of significant changes but cannot always do so.

11. Ending this

You can stop using BlinkPop and delete your account at any time. We may suspend or terminate your account if you break these Terms, if we are required to by law, or if we discontinue the Service. Sections 4.2, 7, 9, 12, 13 and 14 survive termination.

12. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or accurate — including that a Pop will take place, that a place’s details are correct, or that another user is who they claim to be.

Nothing here excludes any liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Service.

Our total liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you have paid us in the twelve months before the claim, and (b) USD 50. BlinkPop is free, so in practice this is usually USD 50.

14. Indemnity

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your content, your use of the Service, your breach of these Terms, or your conduct towards another user — except to the extent the claim arises from our own wrongdoing.

15. Governing law

These Terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer laws of the country where you live, or of the right to bring proceedings there.

There is no arbitration clause in these Terms, and no waiver of your right to go to court or to participate in a class action.

16. Apple App Store

If you downloaded BlinkPop from the App Store: these Terms are between you and us, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price — which for BlinkPop is nothing — and Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory non-compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. General

These Terms, with the Privacy Policy, are the whole agreement between us. If any part is found unenforceable, the rest stands. Our not enforcing something is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours if BlinkPop is incorporated or acquired. We may update these Terms — the date at the top will change, and for material changes we will give notice in the app or by email before they take effect. Continuing to use BlinkPop after that means you accept the updated Terms.
